Hawaii Declaration from the State Insurance Commissioner regarding assistance of nonresident independent adjusters due to fires across the state

"Pursuant to Hawaii Revised Statutes (“HRS”)§ 431:9-201(b), Insurance Commissioner Gordon I. Ito is issuing this declaration authorizing temporary assistance of nonresident independent adjusters due to fires across the State. The Insurance Commissioner has decided to allow nonresident independent adjusters to operate in the State temporarily to help handle the amount of work due to the fires. The Insurance Commissioner wants to ensure that adjusters and insurance companies can and will timely respond to property owners’ needs."


New York Temporary Adjuster Permits

"Governor Kathy Hochul today directed the Department of Financial Services to issue Temporary adjuster Permits to qualified out-of-state independent insurance adjusters, in order to expedite insurance claims in light of the winter storm impacting the Buffalo and Watertown areas. Expediting permits will increase the number of adjusters available to process claims and help New Yorkers get their claims paid faster. Insurers are encouraged to make any necessary applications on the Department of Financial Services website.  "

Commissioner Lara urges insurance companies to cover reimbursement costs for those displaced during wildfires

LOS ANGELES, Calif. — To assist Californians displaced by the current and recent wildfires throughout the state, Insurance Commissioner Ricardo Lara issued a Notice to all California property and casualty insurance companies urging them to cover Additional Living Expenses (ALE) for those policyholders who remain under mandatory evacuation or whose homes are otherwise inaccessible or uninhabitable due to the wildfires.

Re:   COVID-19: Suspension of certain licensing requirements and fees

On March 13, 2020, Governor Greg Abbott issued a disaster declaration in response to the COVID-19 pandemic. The Governor authorized the use of all available state and local government resources necessary to cope with the disaster.

TDI expects carriers to work with their policyholders as they prepare for and respond to the spread of COVID-19. Carriers should look to the Governor’s ongoing declarations related to COVID-19 for guidance on how long to extend relief.

California Senate Bill 240

SB 240, as amended, Dodd. Insurance Adjuster Act.

Existing law creates the Department of Insurance, headed by the Insurance Commissioner, and prescribes the department’s powers and duties. Existing law, the Insurance Adjuster Act, sets forth various requirements with respect to operation as an insurance adjuster in this state and prohibits a person from engaging in a business regulated by the act, or acting or assuming to act as, or representing themselves to be, an insurance adjuster unless the person is licensed under the act. Existing law also prohibits a person from falsely representing that the person is employed by a licensee. Existing law exempts a person from the requirements of the Insurance Adjuster Act if the person is employed exclusively and regularly by one employer, as specified, with which the person has an employer-employee relationship. If the commissioner declares an emergency situation, existing law authorizes a nonlicensed insurance adjuster to adjust claims if certain requirements are met, including that the nonlicensed insurance adjuster registers with the commissioner via a written letter naming the nonlicensed adjuster, identifying adjuster licenses held in other jurisdictions, and stating when the claims adjusting activity began in the emergency situation. Existing law requires an insurer to provide an insured with a written status report if the insurer assigns a 3rd or subsequent adjuster to be primarily responsible for a claim within a 6-month period.

November Wildfires: Notice of Shortage of Accommodations for Survivors

The California Department of Insurance has been informed by the Governor’s Office of Emergency Services (CAL-OES) that, due to the recent wildfires, there is a shortage of available lodging in the disaster areas. CAL-OES is requesting that insurance companies, adjusters, and other insurance personnel find lodging outside of the disaster areas.

OKLAHOMA DOI decides to police the entire country for license compliance.  Upon my recent submission for license renewal as a Non-Resident, the DOI rep Nicki has decided to question my standing with my home state of Nevada!  I am complete good standing with Nevada, and havre offered to provide a "Letter of Good Standing", which Nicki refused to accept. She is demanding my continuing education formal receipts. She refuses to accept any certificates issues by attending classes such as NFIP, Symbility, etc.  In a very rude 1970's condescending government attitude, she asked if she could just cancel my request, and keep the monies I've paid!  She said that she is just enforcing state statutes, and snottingly that I have 60 days to comply from her first response. REMEMBER, this was a Non Resident license.  I hope she can write estimates!!


Study: State insurance licensing reciprocity benefits everyone

A new study has found that the current system of licensing regulations for independent claims adjusters is causing more harm than help for the industry.

The study, entitled “Breaking Down Barriers” by Pacific Research Institute, found that the average claims adjuster holds between 10 and 12 different state licenses. This can set them back as much as $1,000 each. The study pointed out that these “costly, burdensome state requirements” make it more difficult for adjusters to operate across states, while driving up costs for consumers and limiting the opportunities for new adjusters.

At present, 34 states require independent adjusters to hold a license, the Association of Claims Professionals (ACP) reported.

SACRAMENTO, Calif. — Insurance Commissioner Dave Jones directed the California Department of Insurance to issue a formal notice to insurers, licensed public adjusters and admitted carriers to make sure all claims adjusters assigned to wildfire claims, including those not licensed in California, are properly trained on the California Unfair Practices Act, Fair Claims Settlement Practices Regulations, and all laws relating to property and casualty insurance claims handling.
