Claims adjusters' authority to decide questions of coverage and liability, assess losses and make or recommend settlements shows that they exercise "discretion and independent judgment'' in carrying out company policy, and thus are exempt from overtime, said the Ninth U.S. Circuit Court of Appeals in San Francisco. Insurance companies reported they'd had more than 200 claims and that the numbers were rising as people assessed damage. Still, other residents were finding out that they're homeowner insurance policies don't cover earthquakes." ... "Earthquake is considered a catastrophe like hurricanes or floods, and that isn't covered by the basic homeowner's policy," said State Farm spokeswoman Carolyn Fujioka. Another 1,100 came in to Nationwide Mutual Insurance Co., while State Farm Mutual Insurance Co. collected about 1,500 and Allstate took in 500 reports. Already, all four insurers, as well as Liberty Mutual Group and St. Paul Travelers Cos., have sent special catastrophe teams to Buffalo with dozens of claims representatives, and designated claims from Western New York for expedited attention. From the article: "Troopers say Cetrone was driving eastbound on I-12, when a ladder flew from the bed of his pickup truck. Cars behind Certrone's started to swerve, according to State Police, and an 18-wheeler crossed the median and crashed into a Lexus traveling westbound.

The forecast reduces the numbers yet again. For the remaining season which ends on November 30th, the forecast calls for 2 Named Storms, 1 Hurricane and no hurricanes of Cat 3 or greater intensity. The following statement is made on the forecast. "We have experienced average hurricane activity through September. August was inactive, but September had above-average activity. We expect October to have below-average activity largely due to developing El Niño conditions in the central and eastern Pacific. November activity in El Niño years is very rare."
