With respect to the issue of a vendor contract stating that the work product is the property of the vendor, this is a binding provision, provided however the vendor has first in fact tendered valuable consideration for said product, i.e. payment to the adjuster.

If the vendor has failed to pay the adjuster than that part of the contract is not valid while the balance of the contract remains in force. Further, regardless of any langauge in the vendor contract, if any part of such contract is held to be in violation of such state statutes that govern contract law for the jurisdiction agreed upon in the contract, than that part of the contract, by statute, is held null and void.

Bottom line.....if the vendor didn't pay for it, they don't own it!

Thank you all for responding to this post.  I have had many adjusters offering to help me collect.  I have sent this adjuster many emails giving him the opportunity to pay and respond which he has failed to respond.  I told him that I would take further action if payment was not received or if I did not get a response from him and still he failed to respond.  I highly doubt he intends to pay and I feel it is safe to say that he never intended to pay.  I have learned my lesson but I haven't lost my trust in the adjusters.  There is usually a bad apple in any bunch. 

The adjusters name is William and his email is catadjuster66@aol.com.  I will withhold his phone number.  If any of you know this adjuster please send me a private email.

Robin, I have not read this thread from beginning to end and you may have answered my question, but how much does the adjuster owe you?

I searched on AOL and he did not post any information there. I sent him a friendly email and suggested that he might want to pay you since the Adjusting world is sort of small; he should protect his and our reputation. No response nor do I expect one.

I sent William another email and resent my invoice to him.  I would greatly appreciate more emails be sent to him at catadjuster66@aol.com .  Email other adjusters you work with or have worked with.  Maybe someone will know someone who knows someone.......  I am not all that concerned about the money but more that there is an adjuster using this site and using services advertised on this site but failing to pay for the services he agreed to.
