A friend rented an apartment to a female who checked out ok. 10 months later she let her boyfriend move in "to get on his feet". He turned out to be a big local drug dealer the Police had been watching for a year. 3 weeks after the move in, the Police raided the apt breaking in the back door and breaking among other things the glass top stove. Police say they won't pay unless they made a mistake and went to the wrong apt. They arrested the guy and charged him with possession of cocaine, crack cocaine and heroin in his possession at the time and location of the break in. This all occured in the state of NH. I have no knowledge of the type policy the owner had in force on the apt building.
The question is Would the owners of the apt building policy pay for this or what does she do to collect for the damages. By the way the original renter, the girl friend is asking for her deposit back on the unit.

In my opinion that all comes from the security deposit.  Her boyfriend and herself are the cause of the damage.  The lease must of said something about illegal activity/drugs.  How did the glass stove top get broken???

The Police broke the stove top on entering the apt. I certainly would keep the security deposit for the damages, however I don't think it was large enough to cover all of the damage.

The owner of the apartment/building may be able to make a claim under his/her policy.  If it is an all risk policy it should be covered, unless excluded.  The exclusion for illegal activities or governmental action may apply.  Gotta read the policy!

I would read the policy as most policy's do exclude illegal activity. As far as the girl wanting her deposit back, she has a big set of B--ls. If it wasn't for her boyfriend this would have not been an issue. She doesn't get her money back!!!!

Typically the owner of the apartment or complex carries a policy that only covers the building structure - not the personal property owned by the tenant.  The tenant should carry a renters policy for this type of loss.  If the tenant did not purchase a renters policy then noone is liable for the repairs to the personal property in the apartment.

The landlords policy will pay for the door, stove and other building items.

The illegal activites clause would not apply because the boyfriend is not the insured.

The girl is probably on the hook for all the damages due to her multiple violations of the lease, expect subrogation from the insurer or small claims from the landlord. And she's lucky the police didn't shoot in tear gas and ruin all her stuff.

And good luck finding another landlord that will rent to her.

The police bear no responsibility. They did nothing wrong.
