 9/29/2023 Update: FEMA has revised its NFIP Adjuster Fee Schedule. The revised NFIP Adjuster Fee Schedule will be effective on October 1, 2023, and is applicable to claims with dates of loss on or after October 1, 2023. The 2022 Increased Cost of Compliance (ICC) Fee Schedule was not revised. You can follow this link for the source of this update which is the WYO Company Bulletin W-23013

Hawaii Declaration from the State Insurance Commissioner regarding assistance of nonresident independent adjusters due to fires across the state

"Pursuant to Hawaii Revised Statutes (“HRS”)§ 431:9-201(b), Insurance Commissioner Gordon I. Ito is issuing this declaration authorizing temporary assistance of nonresident independent adjusters due to fires across the State. The Insurance Commissioner has decided to allow nonresident independent adjusters to operate in the State temporarily to help handle the amount of work due to the fires. The Insurance Commissioner wants to ensure that adjusters and insurance companies can and will timely respond to property owners’ needs."


S.C. Private Flood Insurance Act Enacted, Aims to Make Flood Insurance More Accessible

This Act aims to foster innovative flood insurance coverage in South Carolina, allowing insurers the ability to test products in the market and offer consumers greater choice for flood insurance coverage.  — In response to California’s latest destructive fires, Insurance Commissioner Ricardo Lara is requesting that insurance companies help wildfire survivors who are overwhelmed with the task of navigating the claims process by providing up to 100 percent of personal property coverage limits without a detailed inventory to those who suffered a total loss of their home, similar to previous identical requests in past years.

Commissioner Lara urges insurance companies to cover reimbursement costs for those displaced during wildfires

LOS ANGELES, Calif. — To assist Californians displaced by the current and recent wildfires throughout the state, Insurance Commissioner Ricardo Lara issued a Notice to all California property and casualty insurance companies urging them to cover Additional Living Expenses (ALE) for those policyholders who remain under mandatory evacuation or whose homes are otherwise inaccessible or uninhabitable due to the wildfires.

"Commissioner Lara called on the insurance industry to assist small businesses facing layoffs and lost income due to business closures and government actions to prevent the spread of COVID-19. Insurance company responses to the data call are due by April 9, 2020, and will help the Department understand the number and scope of commercial business interruption type coverages in effect and the approximate number of policies that exclude viruses such as COVID-19. This data will help inform state policymakers on solutions to protect businesses.


Identification of Water Damages in Adjusting Hurricane Claims for Water Losses Other Than Flood

In adjusting hurricane damage claims for homes within the 1968-1997 applicable residential code period, it is important that the inside of the walls be checked more carefully than
newer construction to ensure that moisture hasn’t seeped into the walls that will eventually result in mold and interior wall rot. If adjusters do not look for moisture build-up trapped inside the wall, then this damage could be missed, causing mold and rot to proliferate and resulting in bigger problems for homeowners in the future.

SACRAMENTO, Calif. — In the wake of the deadliest and most destructive wildfire in California’s history, Insurance Commissioner Dave Jones today declared an emergency situation, which allows insurance companies to use out-of-state adjusters to help handle the large volume of claims resulting from the Camp and Woolsey Fires.

November Wildfires: Notice of Shortage of Accommodations for Survivors

The California Department of Insurance has been informed by the Governor’s Office of Emergency Services (CAL-OES) that, due to the recent wildfires, there is a shortage of available lodging in the disaster areas. CAL-OES is requesting that insurance companies, adjusters, and other insurance personnel find lodging outside of the disaster areas. 


Notice Issued to Protect Oklahomans Who Have Earthquake Insurance

OKLAHOMA CITY – The Oklahoma Insurance Department is taking a proactive step to protect Oklahomans who buy earthquake insurance. Today the Department released a bulletin to property and casualty insurance companies to address important issues surrounding earthquake insurance. 

“We want to make sure everyone is clear on earthquake insurance,” said Oklahoma Insurance Commissioner John D. Doak. “Oklahomans need to know what they are buying. Insurers need to know my expectations regarding the interpretation of polices.  And adjusters need to know how to evaluate an earthquake claim.”

Alaska Independent Adjuster Licensing Information

Independent Adjuster
An independent adjuster represents the interests of the insurer.

You need an independent adjuster license to adjust claims on behalf of an insurer that is not your employer.

Reciprocal Nonresident License
You are required to hold an independent adjuster license in your home state to qualify for a reciprocal license.

If your home state does not offer an independent adjuster authority, you will need to pass the Alaska Adjuster exam, and Alaska will be your designated home state.

Unlicensed Adjuster Single Loss or Catastrophe

Does Alaska have any special provisions that apply to adjusters who may need to only adjust
a single loss or adjust catastrophe losses?

Yes. A nonresident independent adjuster, who is not Alaska-licensed but who is licensed and in
good standing in his or her home state may act as an adjuster and adjust a single loss in this state
during a calendar year, or may act as an adjuster and adjust losses arising out of a catastrophe
(which is declared by the director) if, within 10 days after the start of the investigation or
adjustment, the nonresident adjuster advises the director in writing of the adjustment (AS
21.27.860(a)).

An unlicensed adjuster is required to comply with the Unfair Claims Trades Practices
Regulations. 


Alabama Independent Adjuster Requirements

Definition

An "independent adjuster" is a person who, for compensation as an independent contractor or as an employee of an independent contractor, undertakes on behalf of an insurer to ascertain and determine the amount of any claim, loss, or damage payable under a contract of property, casualty, or workers' compensation insurance or to effect settlement of such claim, loss, or damage. Ala. Code § 27-9A-3.

Procedure for Catastrophic Adjusters

The purpose of this bulletin is to outline procedures your company will need to follow if a catastrophic event were to occur in North Carolina. NC Emergency Management staff will not allow any adjuster access to a declared disaster area unless the adjuster is carrying proper identification. 
 


Texas HB 272 - Relating to the operation of the Texas Windstorm Insurance Association

Highlights from the Bill

Deadline for Filing Claim: (1)require an insured to file a claim under the policy not later than the first anniversary of the date on which the damage or loss that is the basis of the claim occurs; The commissioner, on a showing of good cause by a person insured under this chapter, may extend the one-year period described by Subsection (a)(1) for a period not to exceed 90 days.

The association may not pay or settle a claim described by Subsection (a) unless the person filing the claim provides evidence satisfactory to the association that, on the date of the loss that is the basis of the claim, the property insured under the association policy was also covered by a flood insurance policy in the amount required for issuance or renewal of the association policy under Section 2210.203(a-1).
 
Not later than the 30th day after the date a person insured under this chapter files a claim with the association, the association shall provide the person notice of whether the claim is accepted or denied and, if the claim is accepted, a written appraisal of the damage to the insured property

Flood Adjuster Capacity Program Manual

This manual has publish date of July 2019, here is a summary from the manual.

"FEMA is dedicated to increasing the nation’s disaster resiliency. To this end, FEMA’s NFIP is working hard to increase the number of households and businesses that are protected by flood insurance. As the flood insurance policy count grows, FEMA will need to maintain a high level of customer satisfaction throughout the claims process. To make this possible, FEMA has initiated the Flood Adjuster Capacity Program (FACP) and is partnering with WYO Companies, independent adjusting firms, and individual adjusters to increase the number of claims adjusters who are trained and available to help NFIP policyholders after flood events. The FACP will work to strengthen and enhance recruitment, training and professional development for claims adjusters nationwide."
