Win may cost insurers billions - Wind vs Flood again

8/31/2007 Update;

By a 3-2 decision, the Third Circuit Court of Appeal in Lake Charles remanded the Vermilion Parish case Landry v. Louisiana Citizens Property Insurance Corp. for a trial on what ruined the Landrys' home, but set up a test for when the valued policy law can force insurers to pay the policy limits on a home that was completely destroyed.  from a this Nola.com article.

It is good to see a jude finally take a stand and make the companies explain in full as to the intentions of their policy. Now someone should make the agents liable for their salesmanship practices.

It's very difficult to imagine that anyone living along the gulf coast doesn't know the drill and isn't aware of the coverage issues. They made a choice. My question is: who's going to pay for this in the long term?

what method of calculation does one use on something that is not covered? ZERO?
This decision defies logic and emasculates contract law.
