TDI Bulletin -Recommending Building and Repair Contractors

TDI reminds all persons, including adjusters, building and repair contractors, and insurers, that pursuant to Section 543.001, an insurer, its representative or any other person may not misrepresent the terms and provisions of a policy. Further as stated in 28 Tex. Admin. Code §5.9970(d) and (e), persons insured under a homeowners or dwelling policy are entitled to have their home repaired by the person of their choice.  Further, pursuant to the Insurance Code §542.003(a), an insurer engaging in business in this state may not engage in an unfair claim settlement practice.  Not attempting in good faith to effect a prompt, fair, and equitable settlement of a claim submitted in which liability has become reasonably clear constitutes an unfair claim settlement practice under the Insurance Code §542.003(b)(4).

I am currently working hurricane ike. I have a 7 building apartment complex damaged by storm in houston. The adjuster and his "contractor" agreed the shingles need to be totally replaced. The life expectancy has been futhrer voided from the storm, however the siding they say has not. My question is, how can you say the life expectancy of roofing has been effected, but all the loose siding, buckled and saturated siding has not been? Yes, it is old, exactly my point, its life expectancy has been futher deteraited by the storm and bears replacing and repainting...

I have since renegoiated with adjuster on property concerning siding per hurricane IKE. The insurance company has agreed to give an alotment per building to renail resecure. This is typical of what we go thru as consultants to insure a fair and equitable settlemtent on behalf of the insured.
